Terms of Service

These terms cover the First-Call System supplied by Splash Xedia LLC, 1910 Thomes Ave, Cheyenne, WY 82001, trading as Floww. By using the service you agree to them.
What we provide
We build, install and run a lead-response system for your business. Depending on your plan that includes calling new leads within 60 seconds of a form submission, bridging the call to your team, an automated assistant that qualifies and books when nobody answers, follow-up calls and messages, calendar booking, call recording and reporting.
What it costs
A one-time setup fee and a monthly retainer, agreed in writing before work starts. Telephony and AI usage are billed separately at cost plus 20%. The setup fee is payable before the build begins. Monthly fees are billed in advance and are non-refundable except under the service credit below.
Speed guarantee
We aim to dial every new lead within 60 seconds, 24 hours a day, and we timestamp every one. If we miss 60 seconds on more than 2% of your leads in a calendar month, that month's retainer is credited. We audit this ourselves and apply the credit without you asking.
This is a guarantee about speed, which we control. We do not guarantee revenue, jobs won, appointment volume or close rates, because those depend on your leads, your offer and your team.
Your responsibilities
- Your lead forms must carry clear consent language telling people they will be contacted by phone and text about their enquiry
- You may only send us contact details that came from your own forms, ads or customers — never purchased, scraped or rented lists
- Your team answers the calls the system routes to them, and you tell us who should receive them
- You give us the access we need (lead form, calendar, CRM) and approve the call scripts before go-live
- You comply with the laws that apply to your own marketing, including the TCPA and state calling rules
Acceptable use
The system may not be used for cold outbound calling, debt collection, political or charitable campaigns, or any unsolicited marketing. We will suspend the service immediately if we believe it is being used that way, and we may end the agreement without refund.
Calls, recordings and compliance
Calls are recorded. Automated calls disclose that they are automated. We apply quiet hours so nothing dials outside permitted local calling times, and we screen against do-not-call requests. You remain responsible for the consent captured on your own forms.
Ending the agreement
Either side can end the monthly service with 30 days written notice. On termination we stop the system, hand over your call recordings and lead records on request, and delete our copies within 90 days. Setup fees are not refundable once the build has started.
Liability
We provide the service with reasonable skill and care, but we do not warrant that it will be uninterrupted or error-free — it depends on third-party networks, telephony carriers and platforms outside our control. Our total liability in any 12-month period is limited to the fees you paid us in that period. We are not liable for lost profits or lost business.
Governing law
These terms are governed by the laws of the State of Wyoming, United States.
